Terms of Service

TakeOwl is a restaurant discovery and ordering platform. We list local restaurants that handle their own pickup and delivery — connecting customers directly with restaurants without taking a commission on food sales. We may also provide tools for restaurant owners to manage orders, menus, and customer communications.

TakeOwl is currently in beta. Features may change, be added, or be removed as we develop the product. We will do our best to communicate significant changes in advance.

To access certain features you must create an account. You agree to provide accurate, current, and complete information when registering, and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

You must be at least 18 years old to create an account. We may suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

Restaurants may be listed on TakeOwl by our team, by restaurant owners, or by community contributors. We make reasonable efforts to keep listing information accurate, but we do not guarantee the accuracy, completeness, or timeliness of any listing — including hours, menus, pricing, or contact information.

Restaurant owners who claim their listing are responsible for keeping their information up to date. By submitting or editing a listing, you confirm that the information is accurate to the best of your knowledge and that any ordering links point directly to the restaurant's own ordering system — not to third-party commission-based platforms.

When you place an order through TakeOwl's built-in ordering flow, you are entering into a transaction directly with the restaurant. TakeOwl is not a party to that transaction and is not responsible for the preparation, quality, accuracy, or fulfillment of any order.

TakeOwl charges a flat service fee of $0.50 per order for orders placed through our ordering system. This fee covers platform costs and is disclosed at checkout. Restaurants are responsible for setting their own prices, delivery fees, and minimum order amounts.

Order confirmations and status updates are provided as a convenience. TakeOwl does not guarantee that a restaurant will accept, fulfill, or respond to any order within a particular timeframe. If you have an issue with an order, your primary recourse is with the restaurant directly.

Payment processing services for orders and subscriptions on TakeOwl are provided by Stripe. By making a purchase or placing an order through TakeOwl, you agree to Stripe's Services Agreement.

Restaurant owners who receive payouts through TakeOwl's ordering system are connected accounts on Stripe's platform. By connecting a payout account, restaurant owners agree to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement. As part of the onboarding process, Stripe may collect identity, banking, and business information directly from restaurant owners. TakeOwl does not store or have access to bank account numbers or sensitive financial credentials.

TakeOwl deducts a small per-order platform fee from each payout before funds are transferred to the restaurant. The fee amount is disclosed during onboarding and in your account settings.

Restaurant owners may purchase a subscription to unlock premium features on TakeOwl, including TakeOwl-powered ordering, detailed analytics, and review management tools. Subscription fees are billed on a recurring basis as disclosed at the time of purchase.

Subscriptions automatically renew on a monthly or annual basis. You may cancel at any time through your account settings or the billing portal. Cancellations take effect immediately and a prorated refund for any unused portion of the current billing period will be issued to your original payment method.

Listing a restaurant on TakeOwl is always free and is not dependent on having a subscription.

Community members may submit restaurant listings, edits, reviews, and photos. By submitting content, you grant TakeOwl a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content as part of the Service.

You represent that any content you submit is accurate, does not infringe any third-party rights, and does not violate any applicable law. We reserve the right to remove any content that we determine, at our discretion, to be inaccurate, misleading, offensive, or otherwise in violation of these Terms.

Customer reviews are the opinions of individual users and do not represent the views of TakeOwl. We do not verify the accuracy of reviews. Reviews must be based on genuine first-hand experience and may not be used to harass, threaten, or defame a restaurant or its staff.

We reserve the right to remove reviews that violate these Terms or that we reasonably believe are fake, incentivized, or submitted in bad faith.

You agree not to:

• Use the Service for any unlawful purpose
• Submit false, misleading, or fraudulent information
• Attempt to gain unauthorized access to any part of the Service or its underlying systems
• Scrape, crawl, or use automated tools to collect data from the Service without our written permission
• Interfere with or disrupt the Service or servers connected to it
• Submit reviews or listings you know to be inaccurate or fabricated
• Use the Service to advertise or promote third-party commission-based delivery platforms

All content, design, code, logos, and trademarks associated with TakeOwl are owned by or licensed to TakeOwl LLC. Nothing in these Terms grants you any right to use our name, logo, or branding without prior written permission.

Restaurant names, logos, and images displayed on TakeOwl are the property of their respective owners. If you believe content on TakeOwl infringes your intellectual property rights, contact us at hello@take-owl.com.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

We are not responsible for the actions, content, or representations of any restaurant listed on TakeOwl, and we make no guarantees about the quality, safety, or legality of any restaurant's food, service, or ordering process.

TO THE FULLEST EXTENT PERMITTED BY LAW, TAKEOWL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TAKEOWL IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50.

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If we make material changes, we will make reasonable efforts to notify you — for example, by posting a notice on the Service or sending an email to the address on your account.

Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of the United States and the state in which TakeOwl LLC is registered, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction, and you consent to personal jurisdiction there.
